These Terms govern access to the ReSell mobile application, website, public pages, and related services (the “Service”). By creating an account, accepting the policies, purchasing a paid feature, or using the Service, you agree to these Terms, the Privacy Policy, Community Guidelines, and any applicable Subscription Terms or Paid Features Terms.

1. Eligibility

You must be at least 18 years old and legally capable of entering a contract. You may not use ReSell if prohibited by law or if your account was disabled for serious or repeated violations and you do not have permission to return.

2. The Service

Depending on availability, ReSell may provide:

• Marketplace listings and listing management
• Public profiles and people search
• Nearby discovery, filters, and approximate distance
• Favorites
• User-to-user messaging
• Stories and events
• Reviews and ratings
• Reporting, blocking, moderation, and account controls
• Seller analytics
• Sponsored-listing campaigns
• ReSell Pro subscriptions
• A separate paid profile badge
• Guest marketplace browsing and public listing, profile, and event links on the ReSell website

Features may be added, changed, suspended, tested, limited by platform, or removed.

3. Marketplace transactions

ReSell provides listing, discovery, communication, and related tools. Except for digital features purchased from ReSell through Apple or Google, ReSell does not process buyer-to-seller payments, hold funds, provide escrow, provide shipping, authenticate goods, guarantee users, guarantee legal ownership, inspect items, or guarantee completion of a marketplace transaction.

Buyers and sellers are responsible for inspecting items, selecting safe meeting and payment methods, complying with law, and resolving transaction disputes.

4. Accounts and security

You agree to provide accurate information, maintain a valid email address, protect login credentials, use only authorized accounts, and notify us of suspected compromise. You may not create accounts to evade blocks, restrictions, suspensions, or moderation.

New account creation through email, Apple, or Google requires an affirmative confirmation that the user is at least 18, agrees to the Terms of Service, Subscription Terms, and Community Guidelines, and acknowledges the Privacy Policy. ReSell records the applicable policy version and acceptance time. Existing users may be required to acknowledge material policy updates before continuing.

We may verify account access, assign public and internal identifiers, restrict features, require policy acknowledgement, or disable an account for security, legal, fraud, safety, or policy reasons.

5. User content

“User Content” includes listings, photos, profile information, stories, events, reviews, messages, reports, evidence, and other content submitted through the Service.

You represent that you have the right to submit the content and that it is lawful, accurate, non-infringing, and compliant with these Terms and the Community Guidelines.

You retain ownership of your User Content. You grant ReSell a non-exclusive, worldwide, royalty-free license to host, store, copy, process, format, display, transmit, distribute, moderate, preserve, and use it as reasonably necessary to operate, secure, improve, and enforce the Service and comply with law. Public-content licenses end when the content is deleted from active systems, except for backups, safety records, legal retention, and content already shared with others.

6. Listings

Listings must accurately describe a lawful item, price, condition, availability, and approximate location. You may not use misleading photos, hidden fees, bait-and-switch pricing, keyword spam, counterfeit claims, stolen goods, or prohibited content.

ReSell may hide, remove, preserve, restrict, or re-rank listings at any time for safety, legal, quality, technical, promotional, or policy reasons.

7. Profiles, search, location, and favorites

Public profile information and public content may be visible to users and website visitors. ReSell may use private coordinates to provide nearby results while showing an approximate public location.

Search results and listing order are not guaranteed. Results may consider factors such as sponsored status, active ReSell Pro status, location, recency, relevance, safety status, availability, and randomized ordering among comparable items. Favorites do not reserve an item or guarantee availability.

8. Messages

Messaging is for lawful, respectful marketplace communication. Messages are not end-to-end encrypted. ReSell may access or review them when necessary for support, moderation, reporting, fraud prevention, legal compliance, or security.

9. Stories, events, and reviews

Stories and events must comply with the Community Guidelines. Event creators are responsible for accurate details, lawful activities, permissions, attendee safety, and any required permits.

Reviews must reflect a genuine eligible marketplace interaction. You may not buy, sell, trade, coordinate, threaten, or manipulate reviews. ReSell may remove reviews, recalculate ratings, restrict editing, or preserve transaction context to maintain integrity.

10. Reports, blocking, and moderation

You may report content or users and block abusive users. Reports must be honest and submitted in good faith.

ReSell may use user reports, admin review, technical signals, and available evidence to remove content, limit reach, restrict messaging, suspend features, disable accounts, preserve records, and cooperate with lawful requests. ReSell is not required to monitor all content before publication and does not guarantee that every violation will be detected.

11. Prohibited conduct and items

You may not use ReSell for unlawful, fraudulent, dangerous, abusive, exploitative, infringing, deceptive, or privacy-invasive activity. The Community Guidelines include detailed prohibited-item and behavior rules and are incorporated into these Terms.

12. Sponsored listings

When enabled, sponsored-listing campaigns are one-time digital purchases processed through Apple or Google.

A sponsored campaign:

• Applies only to the selected eligible listing and duration
• Begins only after successful store and server verification
• May receive priority placement while active
• Does not guarantee impressions, clicks, messages, sales, profit, or a specific position
• May stop if the listing is sold, hidden, removed, unlawful, unavailable, or violates policy
• Is non-transferable unless ReSell expressly permits otherwise

Campaign metrics may be estimated, delayed, deduplicated, corrected, or affected by device, network, fraud-prevention, or visibility rules.

13. ReSell Pro and paid profile badge

When enabled, ReSell Pro is an auto-renewing subscription that may provide seller tools, stories, analytics, ranking priority above free sellers, and other listed benefits.

A separate paid profile badge may be offered. The badge is visual only. It does not mean ReSell verified identity, ownership, background, trustworthiness, expertise, item authenticity, or transaction safety. It does not guarantee ranking unless the purchase screen expressly says otherwise.

Products, benefits, eligibility, and platform availability may change prospectively. Current store-displayed price and terms control at purchase.

14. Store billing, renewals, cancellation, and refunds

Digital purchases are processed through Apple App Store or Google Play and are also subject to the applicable store terms.

Auto-renewing subscriptions continue until canceled through the store. Deleting ReSell does not automatically cancel a store subscription. Cancellation generally stops future renewal while access may continue until the paid period ends.

Refunds, chargebacks, billing disputes, purchase reversals, and store taxes are handled according to Apple, Google, applicable law, and ReSell’s published paid-feature terms. ReSell may remove an entitlement after refund, revocation, chargeback, fraud, or failed verification.

15. Intellectual property

ReSell’s software, design, branding, logos, text, and non-user content are owned by the operator or licensors. Except as permitted by law, you may not copy, scrape, reverse engineer, sell, sublicense, interfere with, or exploit the Service.

16. Feedback

You may provide feedback. You grant ReSell permission to use feedback without restriction or compensation, while ownership of your unrelated intellectual property remains yours.

17. Account deletion and termination

You may delete your account in the app or request deletion through the Account Deletion page. Deletion does not automatically cancel store subscriptions and may not erase limited safety, fraud, legal, accounting, or purchase records that ReSell is entitled or required to retain.

ReSell may suspend, restrict, disable, or terminate an account or content for policy violations, security, fraud, legal compliance, safety, or discontinuation of the Service.

18. Third-party services

The Service depends on hosting, database, image, email, notification, app-store, and other providers. ReSell is not responsible for independent third-party services, their availability, or their separate terms.

19. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” TO THE MAXIMUM EXTENT PERMITTED BY LAW.

ReSell does not guarantee users, listings, items, reviews, events, messages, analytics, ranking, location, availability, transaction success, uninterrupted operation, or freedom from errors or harmful conduct.

Nothing in these Terms excludes rights or warranties that cannot legally be excluded.

20. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RESELL AND ITS OPERATOR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OR LOST PROFITS, DATA, GOODWILL, OR OPPORTUNITY.

RESELL’S TOTAL LIABILITY FOR A CLAIM WILL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNT YOU PAID RESELL IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, EXCEPT WHERE LAW REQUIRES OTHERWISE.

21. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless ReSell and its operator from claims, losses, and expenses arising from your content, listings, transactions, events, messages, violations, unlawful conduct, or infringement of another person’s rights.

22. Governing law and disputes

These Terms are governed by applicable United States law and the law of the state where the operator is based, without overriding mandatory consumer protections or conflict-of-law rules that cannot be waived.

23. Changes

We may update these Terms. Material changes may be communicated in the app or website and may require acknowledgement where appropriate.
